Europe shares turn negative before Italy's debt sale

European shares turned negative on Thursday in choppy low volume trade as investors were wary about a sale of longer-term debt in Italy, with Italian funding costs remaining close to levels deemed unsustainable.

Oracle dealt patent defeat in Google Android case (Digital Trends)

The U.S. Patent and Trademark Office dealt Oracle a bit of a setback in its high-stakes patent litigation against Google over Android. In a filing just before the Christmas holiday, the USPTO effectively threw out one of the seven patents Oracle is using against Google (full text available at Groklaw), rejecting some 17 of the 21 claims asserted in U.S. patent 6,192,476. Although only one of those claims was being leveraged against Google?claim 14?the rejection of so many claims basically means the entire patent has been invalidated.

Google requested the patent be re-examined by the USPTO, along with others Oracle is asserting against it in the case. The request for re-examination is common in patent litigation: defendants typically assert both that the aren???t infringing on a particular patent, and furthermore that the patent ought not to have been issued in the first place, and therefore is invalid and nobody could infringe on it even if they tried.

Oracle?s infringement case against Google hinges on the Java virtual machine included in Google?s Android operating system; Oracle claims the technology violates a number of Java patents it acquired along with Sun Microsystems in early 2010. Oracle initially asserted 132 infringement claims against seven patents; the list of claims was reduced to a list of 50 on the request of the judge handling the case; of those, only one (claim 14) was against patent 6,192,476. However, that means Oracle still has six patents in play in its case against Google. The judge has requested Oracle further limit the number of claims it brings to trail; Oracle had been hoping to bring 21 claims, but the judge had suggested Oracle focus on just three claims to streamline proceedings.

Generally speaking, Oracle would prefer to go to trail sooner than later. The case was originally supposed to go to trail in October, but a scheduling conflict lead to a delay. Oracle then asked for a January start date, but Google has dragged its feet, saying it can?t be ready for trail before July.

Oracle has until February 20 to request an appeal the preliminary ruling. Preliminary rulings against patents have been later been overturned upon full review, so Oracle may have a chance of hanging on to the patent after all. If Oracle does nothing, it will likely be stripped of the patent.

AUTOS: Winners And Losers Of 2011

Some of the notable successes and failures from an interesting automotive year...

Winners and losers, every automotive year has them, with cars or technology that either make the grade with critics and consumers or fall short for whatever reason.

Here?s a short list of those that made it and those that didn?t:

Winner: Chevy Camaro ZL1 ? Chevrolet rolled out the most powerful production Camaro ever, powered by a 555-horsepower aluminum V8.

Loser: Honda Civic ? A cheapened interior and softened drivability cause critics to pile on with the negatives, including Consumer Reports which removed Civic from its recommended list.

Winner: Volkswagen Beetle ? VW performs a complete makeover on its retro coupe, addressing longstanding complaints and removing much of its terminal cutesiness.

Loser: Saab ? The slow, dismal demise of this Swedish enthusiast brand was sad to watch as attempts to resuscitate were blocked at every turn.

Winner: Porsche 911 ? The iconic German sports car returns yet again completely updated but still keeping the faith with its 1960s roots.

Loser: Fiat 500 ? Despite charming retro styling and fun drivability, Fiat?s first re-entry to the U.S. market falls flat. Blame is placed on the car being launched without the dealer network to support it.

Winner: Ford Mustang Boss 302 ? Ford reaches deep into its past and produces the rebirth of a storied muscle car, not just in appearance but in performance.

Loser: MyFord Touch ? An attempt to enhance driver interface with a suite of electronic features instead winds up being confusing and distracting, and sent back to the drawing board.

Winner: Hyundai Veloster ? The South Korean automaker stays on top of its game with a sparkling new compact rated at 40 mpg on the highway, and with a third door on the passenger side for backseat access.

Loser: Chevrolet Volt ? The modern world?s first extended-range electric car gets a tepid reception from consumers as well as two incidents with battery fires after crash tests. Chevy brass also takes a beating for its tardy revelation of the battery-fire issue.

Putin resists rerun; Kremlin ideologist out (AP)

MOSCOW ? Facing a swelling wave of public anger over fraud-tainted elections, Prime Minister Vladimir Putin on Tuesday rejected demands for a rerun of the vote, while the Kremlin reassigned the architect of his tightly controlled political system to a job with no apparent domestic political duties.

The order by President Dmitry Medvedev to make Vladislav Surkov a deputy prime minister in charge of economic modernization was variously interpreted as a sign that leaders recognize the need for significant reform and as a cosmetic move with little meaning.

Allegations of fraud in the Dec. 4 national parliamentary election sparked a wave of protests unprecedented in post-Soviet Russia, including two vast rallies in Moscow that attracted tens of thousands. Putin, who was president in 2000-2008, seeks to return to the Kremlin in elections in March, and the protests have undermined his image as the inevitable winner.

Putin and Medvedev have sought to dilute the protests by rolling out a set of proposed political reforms, but have firmly resisted the protest leaders' main demand that the parliament elections be annulled and rerun. Opposition forces also say the proposed reforms are too little and too late.

In a meeting with supporters Tuesday, Putin again took a tough line on the election, saying "there can't be any talk about reviewing it" ? a position likely to lead to more protests.

The protesters have not only denounced the elections, but the entire so-called "managed democracy" political system implemented under Putin, under which parties that do not take their cues from the Kremlin or United Russia have been forced to the far sidelines.

Surkov, whose formal title had been deputy chief of the presidential administration, was seen as the developer of that system. He also is believed to be the creator of the intensely pro-Putin Nashi youth movement despised by the opposition.

Former Finance Minister Alexei Kudrin, a close Putin associate, was quoted by the state news agency RIA Novosti as saying The decision about the departure of Surkov, which I understand was made by Putin and Medvedev, is a very serious order for the renovation of the political system."

But in the view of Mikhail Prokhorov, the tycoon and New Jersey Nets owner who plans to run against Putin in March, "what happened today is no more than the moving of people from one office to another."

Putin on Tuesday urged his supporters to ensure fairness of the presidential vote to prevent any possible criticism, and discussed details of his proposal to put web cameras at all polling stations. He also suggested that all ballot boxes be made transparent.

"As a candidate, I don't need any vote-rigging," Putin said. "I want the election to be maximally transparent. I want to rely on people's will."

Alexei Navalny, an anti-corruption lawyer and popular blogger who has been a key driving force behind the latest protests, vowed that up to a million demonstrators would take to the streets before the presidential election.

Although Putin is seen as still the strongest candidate in the presidential elections, recent polls suggest his support his not enough to win an outright victory in the first round.

His United Russia party retained a slim majority in parliament in the December elections, but lost about 25 percent of its seats. The party's electoral performance, which protesters say would have been even weaker in an honest count, has galvanized opposition forces that were long marginalized under Putin.

Icebreaker reaches stricken Russian fishing vessel

A South Korean polar research ship on Monday reached a leaking Russian fishing vessel that has been stuck in the frigid waters off Antarctica for the past 10 days, New Zealand officials said.

The Sparta, with 32 crew on board, hit underwater ice on Dec. 16 that tore a 1-foot (30-centimeter) hole in its hull and caused it to list at 13 degrees. Several rescue ships had been hampered by heavy ice in the Ross Sea off the northern Antarctica coast before the icebreaker Araon finally pushed through and reached the Sparta on Monday, New Zealand Rescue Coordination Center spokeswoman Rosalie Neilson said.

The arrival was a relief to the crew, which had been desperately pumping out near-frozen sea water while awaiting rescue. At one point, more than half of those on board were forced onto life rafts.

The crew is made up of 15 Russians, 16 Indonesians and one Ukrainian.

A New Zealand air force cargo plane had previously made two parachute drops of pumps and hull patching gear that had helped keep the single-hulled Sparta from sinking.

Search and rescue coordinator Mike Roberts said the South Korean vessel was alongside Sparta transferring fuel to it to change its trim ? or how it's sitting in the water ? so the bow rises clear of the sea, exposing the damaged area of hull.

Roberts said crew from both ships will attempt to weld a "doubler plate" over the hole ? one external and a second inside. If successful, the repair is expected to make Sparta seaworthy, and should enable it to be escorted by Araon out of the sea ice to open water, he said in a statement. Roberts did not say how long the repair attempt was expected to take.

Weather in the area was calm, which should help the repair operation, he said.

The survival drama on the edge of the Antarctic ice shelf is taking place about 2,200 miles (3,700 kilometers) southeast of New Zealand.

Queen Elizabeth's husband receives heart stent

Queen Elizabeth II's husband received a coronary stent Friday after experiencing chest pains, British royal officials said.

Buckingham Palace said Prince Philip, the Duke of Edinburgh, was taken from Sandringham, the queen's sprawling estate in rural Norfolk, to the cardiac unit at Papworth Hospital in Cambridge, where he will remain a "short time" for observation.

"The Duke of Edinburgh was found to have a blocked coronary artery which caused his chest pains,'' the palace said in a statement late Friday. "This was treated successfully by the minimally invasive procedure of coronary stenting.''

During stenting, a blocked heart artery is cleared and propped open with a small mesh tube called a stent. The stent is often fitted through a small incision in the chest during keyhole surgery.

Earlier, officials reported Philip, 90, would undergo "precautionary tests."

The Press Association said Papworth describes itself as the UK's largest specialist cardiothoracic hospital, treating more than 22,800 inpatient and day cases and 53,400 outpatients each year.

Philip is known for his good health and rarely misses royal engagements. He came down with a cold in October and canceled an overnight visit to Italy in order to recover. That illness came shortly after Philip accompanied the queen on a a busy 11-day official royal tour of Australia.

Upon his 90th birthday in June, he announced plans to cut back his official duties, but the BBC said that there had been no suggestion that Philip was in ill health recently.

Born on the Greek island of Corfu in 1921, he served in Britain's Royal Navy before marrying Elizabeth in 1947. They have four children, including the heir to the throne, Charles.

The prince has no clear-cut constitutional role. In private he is regarded as the unquestioned head of his family, but protocol obliges the man dubbed "the second handshake" to spend his public life one step behind his wife.

He has championed numerous charities over the years, but is advising the ones he heads to start planning an orderly transition as he plots the end of his working life.

It had been expected to be a traditional Christmas weekend for the queen's extended family, which now includes the former Kate Middleton, followed by a year's worth of festivities to mark the queen's 60th year on the throne.

Philip traditionally organizes the Boxing Day shoot at Sandringham, British press reported.

Most of the senior royals, including Prince William and his wife, now formally known as the Duchess of Cambridge, will be dispatched across the globe to help the aging monarch celebrate her Diamond Jubilee in grand style.

Elizabeth and Prince Philip had planned to mark the event with a series of tours throughout England.

The culminating celebration in London in early June had been expected to include an unprecedented pageant on the River Thames with up to 1000 boats taking part.

The Diamond Jubilee will mean extra overseas travel for many royals: Prince Charles and his wife, Camilla, will jet off to Australia, Canada, New Zealand and Papua New Guinea; William and Kate will represent the queen in Malaysia, Singapore, the Solomon Islands and the tiny island of Tuvalu; while Prince Harry is being sent to the Caribbean to tour Belize, Jamaica and the Bahamas.

The queen and Philip had planned trips throughout England, Scotland, Wales and Northern Ireland from late March to mid-July. She was then expected to help open the Olympic Games in July before beginning her summer holiday.

The family traditionally exchanges gifts at Sandringham on Christmas Eve.

After the church service, the royals usually walk on the grounds, have a gala lunch, and gather to watch the queen's prerecorded television broadcast, a tradition that began with a radio address by King George V in 1932.

Ford, Kumerow to Miss Bowl Game

Last week the rumors were flying, and today the University of Illinois confirmed that senior running back Jason Ford and redshirt freshman wide receiver Jake Kumerow are academically ineligible under NCAA rules to participate in the 2011 Kraft Fight Hunger Bowl on Dec. 31.

Ford is Illinois? leading rusher in 2011 with 600 yards on 155 carries (3.9 ypc) and seven touchdowns. He finishes his career 1,962 career rushing yards, which ranks 16th on the all-time Illinois rushing list, and 26 career rushing touchdowns, which is second in Illinois history behind only Howard Griffith?s school record of 31.

Kumerow played in seven games in 2011 and had three catches for 15 yards on the season. All three of his catches came in the regular season finale at Minnesota on Nov. 26.

From what I heard, Ford just stopped going to class. While he may be the leading rusher in 2011, he still didn?t live up to his expectations, which means going to the NFL is going to be tough in the first place. Now he will be missing the bowl game, so scouts that maybe gave a poop about him will simply forget he existed. I mean, really he should?ve kept up his academic end of the bargain to, you know, help out the team in what?s already going to be a really difficult game with all the coaching turmoil, etc. But, instead, Ford decided to just stick up his middle finger to the entire team and the fans. I?m only happy that in the process he is completely screwing himself.

I don?t even know who Kumerow is, so it?s not fair to go off on him, and perhaps his issues are slightly different. Also, as a redshirt freshman he is sort of young and can learn from his mistakes. Jason Ford knows better, he apparently just didn?t care.

The Illini will leave for San Francisco on Dec. 26.

German businesses, consumers upbeat despite crisis (AP)

BERLIN ? German business and consumer confidence ended 2011 on a high note despite ongoing fears about the European economy, two closely watched surveys showed Tuesday.

The Ifo Institute's monthly index of business confidence increased to 107.2 points from 106.6, as participants' assessment of their current situation remained unchanged but expectations for the next six months rose.

"Overall, latest Ifo data give ground for optimism that the German economy will weather the ongoing negative influence from eurozone debt crisis developments and the general worsening of prospects for external demand from the rest of Europe fairly well," said Timo Klein, an economist with IHS Global Insight.

Economists had been predicting a drop to 106 amid weakness in the global economy and serious concerns about the financial future of several eurozone countries.

"The German economy seems to be successfully countering the downturn in Western Europe," said Ifo president Hans-Werner Sinn. "This bodes well for Christmas."

Consumer confidence also proved resilient, according to the GfK research institute's forward-looking indicator for January. It remained unchanged from December's 5.6 points as people were optimistic "despite rising economic risks and further escalation of the debt crisis."

There were mixed messages from the survey, however, as German income and economic expectations both rose but consumers' willingness to buy dropped significantly, GfK said.

"Willingness to buy did not benefit from the improvement in economic and income expectations..." Gfk said, noting that it still remained at a "comparatively high level."

GfK said its survey of 2,000 consumers was almost complete before the most recent EU summit in Brussels and that it is unclear whether the inclination to hold back on purchases may now be resolved with the broad agreement reached there.

But it also said that while economic expectations are "defying the rising fears of recession," that might change as the debt crisis hurts German exports.

"With most German companies operating at above average capacity, the labor market is very robust and unemployment figures continue to fall," GfK said. "Whether this trend can be sustained remains to be seen ? the European debt crisis is increasingly likely to become a problem for Germany's export economy."

Dutch consumer confidence, by contrast, fell sharply in December to below the deepest lows of 2008 and 2009, according to a new report Tuesday.

The differing outlook is unusual, given the two economies' close trade links and common view on economic policy, as the Dutch government has consistently backed German policies throughout the crisis.

The country's Central Bureau for Statistics pointed to worries over the Dutch housing market, wage stagnation, and forecasts for a mild recession in the Netherlands in 2012 as key differences.

Ifo, which surveyed approximately 7,000 German businesses, said that their assessment of their current situation remained unchanged for the third month in a row, while expectations for the next six months ticked up for the third month in a row.

Earlier this month, Ifo lowered its forecast for German growth for 2012 to 0.4 percent because of the financial turmoil and a cooling global economy.

The government's independent economic advisers last month predicted that output would expand by 0.9 percent in 2012. Both forecast growth of 3 percent this year.

Another German think tank, the IfW institute, on Tuesday lowered its 2012 growth projection from 0.8 percent to 0.5 percent, while Essen's RWI institute lowered its forecast from 1 percent to 0.6 percent.

Carsten Brzeski, an economist with ING Global Research said that while it is clear that the German economy is cooling, the Ifo results indicate it is "heading towards a soft patch but not falling off the cliff."

"The length of the soft patch will to a large extent be determined by the management of the debt crisis," he said. "The German economy should remain the stronghold of the Eurozone. It is faltering, but not falling."

At some point into the near future, about 2025, the world had used scientific breakthroughs made in 2012 to start fixing the earth as best they could. The process was not easy. Most cities, and economically efficient towns remained rather urban. Otherwise, there was more natural land on the Earth since the amazing change that had been completed in late 2013- early 2014. At this same time, Animals were beginning to evolve some, immediately studied and learned, for there were many new uses for these creatures, as well as dangers that had to be understood?

Hunting is now a major factor to the Earth with the huge numbers of these animals. Even today though, some species are still endangered. Poachers and excess hunting is still possible, by breaking hunting laws and code.

Restaurants are starting to flourish these days with all the new combinations of food. New pets have been showing up, some even reminding us of a certain video game about animals with superpowers?

She was the new girl in town. Her Family moved in from Japan to Rover City, where she would attend an American high school, and learn to live with a place most unfamiliar. She and her parents were off to join her uncle in his restaurant business, which had picked up after half a year of little luck, due to these sudden changes in the world. She remembered it being called the 'Flavor Rush,' her uncle's dream always to master cooking, the art passed down through the girl's family for years, her parents being some of the few to break tradition. That is until she discovered her almost magical ability to make a treasure for the tongue with her hands with relative ease, and has since been working to become assistant chef.

Then came her life at school, which was at hand now. She wasn't too social, but she had a couple friends. However, there was her one strange infatuation with a young man from her classes. She was too shy to ever say 'hello' or anything. She did notice that other girl though, who happened to claim the boy the girl liked, who was from a more successful, popular gourmet restaurant. The rich girl with the fine clothes, golden hair, and eyes like the ocean, and her interest in this same boy, while the boy taking no interest in the 'relationship' himself. Her parents didn't see it, but her uncle, eccentric and sympathetic, had put together the perfect idea to help his little niece: The Aigyuudon, a bowl of beef, rice, and other things like garlic, invented in 1871 and known as 'Gyuudon.' The day the dish had been invented, it became the girl's family's tool of deciding love, for the one who ate the bowl would have their future intertwined with the creator of the dish.

Okay, you see where I'm going with that 'Aigyuudon,' so let me make this clear: The uncle tricked the girl into making the Aigyuudon, and at school, manipulated a couple events so the beef bowl would fall into the hands of the boy, and sure enough, the young man ate it, disliking the awful school food, and digging into the bowl. The young man had been astonished by what he ate, immediately shedding a couple tears of joy, and wanting more very badly, eventually discovering the Flavor Rush restaurant.

But little does the Uncle and the girl realize, he's in for far more than just getting together with the girl. He will be forced to marry her, and produce at least one child, preferably a son, some time when they become adults. As if that wasn't enough, the girl's family starts to make him work for their restaurant at minimum wage, one minute being a busboy, dishwasher, janitor, and god knows what else. That is until he shows off his amazing physical power, and is immediately given the main job of hunting fresh meat for special dishes.

With the girl at his side. You see, the family is pushing for them to become not only a couple, but a tag team in the world of food?But there are some difficulties to their future: The Rich girl girl before is probably pissed, other restaurants don't like competition, the animals will be dangerous, and worst of all, the Aigyuudon love oath can be broken under certain special circumstances?

A simple american teen who enjoys a good bite. After eating the Aigyuudon, he is bound to be with the new girl. He's very strong, and capable of taking on some tough animals.

A young man from England who hunts with 'grace' and 'style,' having been from a long line of hunters, fighters, and sportsmen. He excels at Rugby, Boxing, and wrestling in terms of sports, and has an impressive record of beating many other powerful people and dangerous animals, making him a high class, popular hunter.

Prosecutor: No charges in college basketball brawl (AP)

CINCINNATI ? A prosecutor said Wednesday he has decided against filing criminal charges in an on-court brawl involving University of Cincinnati and Xavier basketball players.

Hamilton County Prosecutor Joe Deters said he made the decision following an investigation that included review of films and interviews with the two teams' coaches and some players and witnesses. He also said that Xavier center Kenny Frease was satisfied with an apology from Bearcat forward Yancy Gates after the two "reached out to each other privately."

Gates punched Frease in the face during the melee. The 7-foot, 275-pound center fell, bleeding from below his left eye, and was kicked by someone else while on the floor. X-rays were normal. The 6-foot-9, 260-pound Gates was suspended by UC for six games.

The two archrivals' annual "Crosstown Shootout" Saturday ended in a melee with punches, shoves and one player getting kicked while on the floor.

Officials and players of both schools have apologized, and both schools suspended four players each. No. 8 Xavier won the game 76-53. It was stopped by referees with 9.4 seconds left.

"This was an unfortunate situation," Deters said in a statement. "However, after talking with both coaches, I truly believe that the teams will be able to deal with the situation more effectively than the criminal justice system."

Messages for comment were left with the two schools' athletic departments.

Criminal prosecutions from player confrontations in sports events are very rare. A handful of National Hockey League players have been charged with assault over the years. But there were no charges in a 2010 melee in Cincinnati between the St. Louis Cardinals and Reds baseball players that left Cardinal catcher Jason LaRue with a concussion after being kicked by Reds' pitcher Johnny Cueto.

After a 2008 brawl between teams in a minor-league baseball game in Dayton, Ohio, a Peoria Chiefs pitcher was convicted of felonious assault causing serious injury for hitting a fan in the head with a ball thrown into the stands.

School officials have said they would work together to promote sportsmanship and cooperation to try to preserve the Shootout, one of Cincinnati's most eagerly anticipated annual events. Xavier students camped out overnight in freezing temperatures to get tickets to this year's home game for the Musketeers.

Xavier guard Tu Holloway was suspended for one game. He acknowledged making comments directed at UC's team right before the brawl, and afterward described his team's toughness as "a whole bunch of gangsters." He said later he regretted using the term "gangsters."

Holloway was irritated during the buildup to the game when Cincinnati guard Sean Kilpatrick said in a radio interview that Holloway, one of the nation's best guards, wouldn't even be a starter on the Bearcats.

Xavier junior guard Mark Lyons was suspended for two games, and freshman Dez Wells and sophomore Landen Amos for four games each.

Besides Gates, suspended Bearcats are starting junior center Cheikh Mbodj (six games), freshman forward Octavius Ellis (four games) and freshman guard Ge'Lawn Guyn, one game.

Watchdogs: Perry team might have violated campaign finance laws ...

Two watchdog groups Thursday called on the Federal Election Commission to look into possible infringements by Republican presidential candidate Rick Perry?s campaign and a pro-Perry super-PAC.

Make Us Great Again might have shared videos produced by the political action committee with the Perry campaign for free or might not have charged the correct amount, Campaign Legal Center and Democracy 21 said in a news release.

?The Perry campaign is prohibited from accepting such in-kind contributions with a value exceeding the $2,500 contribution limit and, further, Super PACs are prohibited altogether from making contributions to candidates,? Campaign Legal Center attorney Paul Ryan said in the release.

?It appears the Perry campaign and Make Us Great Again likely violated these laws and the FEC needs to investigate.?

The two groups, which plan to file a complaint urging investigation with the commission, cite Politico reports as evidence that the groups shared campaign footage.?Three portions of footage used in campaign ads created by Make Us Great Again were also used by Perry?s campaign, the release states.

The Texas governor?s campaign pulled the footage from the public domain, a spokesman for the campaign told The Hill.

Republicans on a private Republican National Committee conference call with allies warned Tuesday that party surrogates should refrain from personal attacks against President Barack Obama, because such a strategy is too hazardous for the GOP.

"We're hesitant to jump on board with heavy attacks" personally against President Obama, Nicholas Thompson, the vice president of polling firm the Tarrance Group, said on the call. "There's a lot of people who feel sorry for him."

Recent polling data indicates that while the president suffers from significantly low job approval ratings, voters still give "high approval" to Obama personally, Thompson said.

Voters "don't think he's an evil man who's out to change the United States" for the worse--even though many of the same survey respondents agree that his policies have harmed the country, Thompson said. The upshot, Thompson stressed, is that Republicans should "exercise some caution" when talking about the president personally.

On the call--which Yahoo News was invited to attend because of a mistake by someone on the staff of the Republican National Committee--Ari Fleischer, the former press secretary for George W. Bush, encouraged Republicans to turn around Democratic attacks lobbed at the GOP presidential candidates (Mitt Romney and Newt Gingrich, for starters) for "flip-flopping."

"I don't like playing defense," Fleischer said. He suggested the listeners to Tuesday's call label the president as a flip-flopper on the following issues: opposing tax increases for those making under $250,000, opposing the Bush tax cuts, opposing raising the debt limit, and opposing a health care mandate.

"When it comes to flip flopping, Barack Obama is the king of flip flopping," Fleischer said. "You can offer that to anybody," he suggested.

Thompson noted that Obama may be boxed in by similarly strong personal approval numbers for Republican lawmakers as he ponders attacking the GOP House majority during the 2012 campaign.

"Obama running against Congress is not going to work," Thompson said.

In a poll conducted in early November by the Tarrance Group and the Democratic group Lake Research for Politico and George Washington University, voters gave their personal member of Congress a 46 percent approval rating--even higher than the 44 percent personal approval numbers for Obama in the survey, Thompson said. (The poll has a margin of error of plus or minus 3.1 percent.)

Fifty-eight percent of the voters surveyed disapproved of how Obama is handling relations with Congress, according to Tarrance's November poll.

"It's a tough road for him when you look at those numbers," Thompson said of the president.

Thompson said that his group's research suggests that voters are giving Obama higher approval on foreign policy than on the issue of jobs and the economy.

Obama calls Pakistan leader about NATO airstrikes

WASHINGTON (AP) ? President Barack Obama has told Pakistan's president that the NATO airstrikes that killed 24 Pakistani soldiers were not deliberate attacks and that the U.S. is committed to a full investigation.

The strikes along the border with Afghanistan last weekend have further strained ties between the U.S. and Pakistan as the Obama administration tries to wind down the war in Afghanistan.

The White House says Obama and Pakistan's president, Asif Ali Zardari, reaffirmed their countries' relationship and agreed to keep in close touch.

Obama called Zardari on Sunday.

Fla. man charged with killing couple with bat (AP)

MIAMI ? A North Florida man has been charged with two counts of first-degree murder after authorities say he beat a man and a woman to death with a baseball bat and then photographed their bodies.

Authorities said Saturday that Craig Arron Lede, 40, of Spring Hill is being held without bond after telling investigators that he killed John Ketsemidis, 29, and Dana Nelson, 28, at Lede's house on Wednesday when he became enraged that a debt couldn't be repaid. The suspect also allegedly drove to the home of the male victim's mother the next day trying to get money while the female victim's body was stashed in the trunk.

"The defendant stated he killed John and Dana because he was tired of being `screwed over,'" Hernando County Sheriff's Detective Randy Wiliamson wrote in an arrest affidavit. "The defendant demonstrated how he swung the baseball bat and struck both victims. The defendant stated he photographed the bodies and intended to keep the picture as a trophy..."

According to a news release from the sheriff's office, Ketsemidis' mother called authorities Friday in a panic because she hadn't heard from her son in a few days. She told authorities that Lede had come by her house on Thursday, telling a bizarre story that her son was at a local hospital and that he needed money. Lede was driving her son's BMW, she said.

Hernando County sheriff's deputies headed to Lede's home that afternoon in an effort to locate Ketsemidis ? they had also traced him to the address through an ankle-monitoring device he was wearing because he was on probation. There deputies noticed what they believed was a body wrapped in a blanket on the garage floor, according to the news release.

"At that time Craig became very nervous and asked the deputies to leave unless they had a search warrant," according to the statement.

Lede, who is unemployed and had a warrant for a probation violation, was immediately taken into custody. It's unclear if he has an attorney.

As deputies pursued an arrest warrant, Lede began talking to investigators at the sheriff's office, authorities said,

Lede said the couple came to his house late Wednesday night and that Ketsemidis said he couldn't repay money he owed him, the news release said. Authorities said Lede became enraged and used a bat to strike Ketsemidis in the head, knocking him to the ground, and then to strike Nelson in the head.

"Once the victims were down and helpless, the defendant struck them in the head and upper body several times causing eventual death," the arrest affidavit says. "The defendant used his camera to photograph the deceased victims."

Authorities subsequently found both bodies in Lede's garage ? Ketsemidis' wrapped in a blanket, and Nelson's in the trunk of Ketsemidis' BMW.

The arrest affidavit says Lede acknowledged that he had "run errands with Dana's body still in the trunk."

Lede was charged with two counts of first-degree murder and one count of armed robbery. Authorities said Lede was wearing a gold Bulova watch that he removed from Ketsemidis' body.

Authorities believe Lede acted alone. He is currently being held without bond.

The St. Petersburg Times reported Saturday (http://bit.ly/uEtXPg ) that Lede has a history of domestic violence and a September 2010 battery charge. His father-in-law David Stenger told the newspaper that Lede once struck Stenger's daughter, prompting her to leave the marriage, file a restraining order against him and begin the divorce process.

Stenger said Lede's behavior worsened following a devastating car accident and he became addicted to painkillers.

Lede and the two victims had all been patients at Hope Pain Management Clinic, which was closed a month ago after a lengthy investigation by the sheriff's office.

"There is little doubt that (prescription drugs) significantly contributed to the deaths of these two young people," Sheriff Al Nienhuis said in a statement. "This is a perfect example that prescription drug abuse is not a victimless or a non-violent crime."

New evidence of an unrecognized visual process

ScienceDaily (Dec. 1, 2011) ? We don't see only what meets the eye. The visual system constantly takes in ambiguous stimuli, weighs its options, and decides what it perceives. This normally happens effortlessly. Sometimes, however, an ambiguity is persistent, and the visual system waffles on which perception is right. Such instances interest scientists because they help us understand how the eyes and the brain make sense of what we see.

Most scientists believe rivalry occurs only when there's "spatial conflict" -- two objects striking the same place on the retina at the same time as our eyes move. But the retina isn't the only filter or organizer of visual information. There's also the "non-retinal reference frame" -- objects such as mountains or chairs that locate things in space and make the world appear stable even when our eyes are moving.

"We asked: what if visual ambiguities are not presented on the same spot on the retina, but on the objects [in the frame] as they move around," says California Institute of Technology cognitive scientist Jeroen J.A. van Boxtel. Indeed, he and colleague Christof Koch found evidence of rivalry in this reference frame, with surprising effects on the better-understood spatial conflict. The findings, which will appear in an upcoming issue of Psychological Science, a journal published by the Association of Psychological Science, offer intriguing clues to how the visual system works.

In their experiments, van Boxtel and Koch created spatial conflict with a "motion quartet," which changes the arrangement of four dots. If the dots are displaced in certain ways, the visual system isn't sure if the movement is vertical or horizontal. If the dots move to an altogether different space, there's no rivalry. Then the researchers upped the perceptual ante by creating an object reference frame with three white discs and shifting it, too, along with or in opposition to the smaller dots.

Seven male and female participants viewed the changing arrangements in four conditions. In one, both dots and discs remained stationary (creating spatial rivalry); in each of two, either dots or discs moved right or left; in the fourth, both moved horizontally together (creating ambiguity in the frame). Each time, participants had to press a button indicating whether the dots moved horizontally or vertically. The presses were analyzed for perceived movement "bias" (more horizontal or vertical) and duration -- evidence either of rivalry or visual clarity.

The results: Even when the dots moved to another space altogether -- so there was no spatial conflict -- the moving discs created the effect of perceptual ambiguity. But the researchers also found that visual rivalry disappeared when the dots were stationary and the disks moved (that is, the dots were not linked to the disks). It was as if the brain had bigger fish -- object-frame rivalry -- to fry.

In subsequent experiments -- one changing the vertical relationship of the dots and one placing the dots outside the white discs -- the researchers got results similar to those they would have gotten without the frame. Their conclusion: The visual system is working out object-frame rivalry as it would spatial rivalry, probably with the same brain regions and processes.
